These Terms of Service ("Terms") govern your use of Qu-Ay (the "Service," "Qu-Ay," "we," "us"). Qu-Ay is currently run by a small, informal partnership based in Australia, not through a registered business; this section will be updated if that changes. By submitting a URL through the Service, you agree to these Terms.
Qu-Ay uses AI-driven browser automation to visit a website URL you submit (the "Target Site"), simulate a shopper browsing and attempting checkout, and generate a report on what it observed. Reports are AI-generated, may contain errors, omissions, or misreadings of a page, and are provided as a fast first-pass review — not a certification, guarantee, or substitute for manual QA, legal compliance review, or accessibility audit.
By submitting a URL, you represent and warrant that you own the Target Site or have the target owner's authorization to run automated interactions against it — including add-to-cart, coupon, checkout, and form-submission testing. You are solely responsible for that representation. We may refuse, suspend, or terminate any audit at our discretion, including where we suspect a submitted site is not one you're authorized to test.
The Service never completes a real purchase or submits real payment information during testing. It does, however, interact with live forms and flows on the Target Site as a real shopper would — which may trigger ordinary side effects of that interaction (for example, an abandoned-cart email or a coupon-code use) on the Target Site's own systems. Submitting a URL means you accept that as part of what an audit involves.
Reports are provided for the price displayed at the time of purchase. Prices may change at any time for future orders. Refunds aren't available once an audit has started, except where the Service fails to deliver a report due to a fault on our end — and nothing in this clause limits any consumer guarantee you're entitled to under the Australian Consumer Law (see clause 6 below).
Reports are AI-generated and provided on a best-efforts basis. They can be wrong, incomplete, or misread a page, and are not a certification, guarantee, or substitute for manual QA, legal compliance review, or accessibility audit. To the extent permitted by law, we make no warranty as to the accuracy or completeness of a report.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded. Subject to that, and to the maximum extent otherwise permitted by law, Qu-Ay's total liability arising out of or relating to the Service is limited, at our option, to re-supplying the report or refunding the amount you paid for the report giving rise to the claim, and Qu-Ay is not liable for indirect, incidental, consequential, or special damages, including any disruption to or effect on the Target Site arising from the audit itself.
You agree to indemnify and hold Qu-Ay harmless from any claim arising out of your submission of a Target Site URL you were not authorized to audit, or your breach of these Terms.
You will not use the Service to audit a site you do not own or are not authorized to test, to abuse or overload the Service, or for any unlawful purpose.
The Service relies on third-party infrastructure to operate, including an AI provider, a cloud browser-automation provider, and an email-delivery provider. See our Privacy Policy for details.
We may update these Terms from time to time. Continued use of the Service after a change means you accept the updated Terms.
These Terms are governed by the laws of Australia.
